Agency relationship
REALTORS work within a legal relationship called agency.
The agency relationship exists between you, as the client, and your
Agent, as the representative of the brokerage or real estate company/franchise.
The essence of the agency relationship is that the Agent has the
authority to represent you in dealings with others.
The Seller's Agent is obligated to protect and promote your interests;
specifically, the fiduciary duties of undivided loyalty, obedience,
confidentiality, reasonable care and skill, full disclosure, and
full accounting.
You can expect competent service from your Agent, knowing that
the brokerage is bound by ethics and the law to be honest and thorough
in every real estate transaction.
REALTORS are required to disclose to clients the representation
you will be receiving. This is usually done with the aid of a brochure
entitled "Agency Disclosure. Signing the brochure does
not obligate you.
Your REALTOR will explain Agency Relationship to you including
the implications and difference between single and dual
agency.
